Is Mediation Required In Colorado For Divorce Cases?

Mediation is a valuable tool in many Colorado divorce cases to reduce conflict and bring parties together for mutually-beneficial settlement of the issues. Mediation is required in many Colorado family law cases, particularly in cases involving child custody disputes. In this video, Denver divorce lawyer Kathlyn Laraway explains how mediation works, when mediation is most effective and whether mediation is a requirement for divorces in Colorado.

So, in every case in Colorado, you’re required to mediate. Every county requires at least two hours of mediation and we think it’s a really great process. I think a lot of cases end up settling in mediation. The only time parties may not mediate is if truly they are able to come to an agreement on every issue without mediating, which probably only happens about ten, 15 percent of the time. You know, it does happen, some people do call and they say, I have, you know, a no-contest divorce, I just need someone to draft all the paperwork. Of course, if that’s really the case here, fees are going to be significantly less but it’s certainly something that we can still help you with to make sure that you get the right agreement drafted, that all the paperwork’s taken care of, your deadlines are met and you’re not stressing about doing that. Sometimes it blows up! Sometimes they think they have an agreement and they find that they don’t, but it certainly does happen where they go forward and they’ve had an agreement and there’s no problem.
