Can My Ex Take Our Child Out Of The State Of Colorado?

Denver Divorce Lawyer On Child Custody

When a divorce is contentious, parents may wonder about the safety of their children during the divorce process. One common concern is that one parent may take the child out of state to avoid a child custody case. In situations like this, be proactive and find an attorney to help you as soon as possible. In this video, Colorado divorce attorney Doug Thomas explains when a parent is allowed to take a child across state borders and how the courts can help parents protect their children.

Video Transcript:

Unfortunately, separations and divorces are not always peaceful. Sometimes, one spouse will try and take the child out of state to deprive the other spouse of seeing that child, so prior to filing a petition for divorce, both parents generally have a legal right to take their children and to travel with those children. If you suspect that your spouse is planning on taking your children out of state, it is very important that you file for divorce in order to get the legal protection you need to keep your spouse from doing that. Once a petition for divorce has been filed, the courts will intervene and prohibit one spouse from taking the children out of state without the court’s permission or the other spouse’s permission. Colorado courts are equipped to handle this and Divorce Matters is equipped to handle this, to seek an injunction from the spouse doing that. It’s not always possible to prevent one spouse from doing that, but the courts have heard this before and are equipped to handle these types of situations.
